Cross-border capacity issues can complicate a French property transaction or inheritance in France, especially when one of the parties lacks mental capacity.

As England & Wales has not ratified the Hague Convention on the international protection of adults, there is no guarantee that an English Lasting Power of Attorney or Deputyship Order will be recognised in France. Acceptance is left to the discretion of each French institution or authority.
